Here is the definition of a lie "A lie (also called prevarication, falsehood) is a type of deception in the form of an untruthful statement". Clicking confirmed shipped when the game is still in your possession is making an untruthful statement to the buyer since the game has not been shipped therefore no matter how you want to look at it you lied end of story.
