I gave them a negative and they sent me a message for me to mark return to sender but I don't know I kind of want to escalate it because it literally looks like they had taken sand paper to it. The intro to the menu plays but as soon as it tries to load the menu it will not read any further. Should I send it back? Or send it to goozex so I can get my points and token back? Also since the other volumes are no longer available I don't really want it anymore. But that was besides the point. It never worked to begin with.

Alright then. By the sound of it, you already left negative feedback, probably best to do a manual cancellation through Goozex. This is how Goozex handles manual trade cancellations:

1. We will ask the buyer to close the trade as they see it. If the game they received is unplayable, then they must leave unplayable feedback.  If the seller couldn't send the game then they need to leave game not received.

2. The seller should then dispute the feedback (this alters the trade in our database for us to start managing)

3. The buyer should then escalate the dispute to Goozex requesting a trade cancellation

4. If the game was received and is unplayable, we will continue with our policy to send the disc to Goozex for inspection.  We do no like, for several reasons, members to ship games between themselves and leave the control of the Goozex system.  For example, we cannot help members if the game was claimed to have been shipped, but never received, meanwhile money was transferred via Paypal.  This, in fact, should be avoided recommendation.

5. Once we have come to a resolution on the manual trade cancellation then we will reverse the negative feedback, refund the buyer, and debit the seller the points and feedback score earned for the trade.

 

I copy and pasted this from what cheeznrice would always provide as the solution, but it's been a while since it's been suggested, so I don't know their exact stance on it is right now. In any case, they should still stand by this, as I asked of something similar when I received a wrong game. Just remember that both sides must explicitly state that they want to cancel the trade and want it sent to Goozex for inspection. They should provide you with the address to send it to. Remember to send a copy of the dispute resolution page (which now that I think about it, I accidentally forgot).

I think escalating it to Goozex would be best. Just respond to him that you think it's best to keep Goozex involve in case something happens, like it gets lost in the mail or something. Assure them that this is the best option for both parties to cancel the trade.

If you want, you could accept the cancel (I'm assuming they requested a cancel) and put return to sender and technically it shouldn't cost any party anything in terms of shipping. Of course, this is if you want to be nice to the sender about it.

If you really feel like it though, you can escalate it to Goozex and cancel the trade that way (both parties have to explicitly state that they want to cancel the trade by sending the item to Goozex). You'd have to send it to Goozex, then they'd inspect it and give your points, token, and reimburse you for shipping in tokens.

I'm not too sure about the legality of the first option though, so the second option would be best for you.

I think I will escalate it to goozex because I don't want to get screwed, even though he asked me to send it back to him I would rather keep goozex in the loop. So would escalating it to goozex be the best option. Since I would like to cancel it since this incident has made me no longer want it anymore. Also what would my reply be to him since he wants me to send it back to him and I would like to escalate it to goozex and cancel it.

I think I will do what you suggested, I sent him a message almost exactly as you said it since it sounds good the way you put it. I mean I don't want to be a douche to the guy but I don't want to lose my points and token in case he screws me over.


Edit: Everytime I mention the fact that I would like to escalate, he is telling me to send it back to him so he can resurface it or something. The problem is it is so badly scratched on the top and bottom that I don't think that will do anything.

If they keep insisting, there's not really much you can do about that. They're either going to have to deal with the negative or cancel it the way you're suggesting.

He just sent a reply stating he has a professional resurfacing machine, my only question is that if he had it to begin with why was it not used before he sent it to me... that just sounds suspicious to me.

one thing you don't want to do is leave a negative feedback. I gave someone an inplayable disc and he left me a negative feedback. I sent him a brand new game the next day with money to send the brolen disc back to me. He could have contacted me first.

I already did we are in dispute right now, I have never had an unplayable disc so I did what someone told me to do is leave a negative and dispute it. I want to escalate it to goozex but he keeps saying he wants it back, but I don't want to get screwed. I have been screwed like this before, not on this site though. Also retaliatory feedback is against goozex rules I believe. Someone correct me if I am wrong.

He still wants me to send it back, even though I have told him I would like to cancel (I did not say this to him) but if I wanted a disc that looks like they used it as a coaster I would have looked in the garbage.

Edit:  I escalated it to goozex so what next>?

not at all or in any way attempting to hijack or sidetrack this thread, but I just really felt it needs to be said that cheeznrice will NOT always provide this information, as would have been very helpful   (and where were you for that matter, Kam, when I could have used a little calm, informative posting?) he will sometimes at least lately ridicule your user name and tell you to stfu, basically. awesome from a moderator.

for those of you who don't know (under rock dwellers, etc) I just received an unplayable disc as part of  a Guitar Hero bundle, (guitar works perfectly) so while slightly different, as in my escalation involves a much higher initial outlay of shipping cost, which supposedly will also be reimbursed (fully? idk) , I am in the same boat as you, Ap o God, and fortunately or un, i don't have prior experience with giving a negative at all. 

My guy also refused to do anything but offer to paypal me the funds to ship it back to him (the game) which on the surface sounds fine, but I am glad to see some written defense of my feeling that I would have potentially been screwed had i done so. I mean I'm really not inclined to trust the guy who didn't even send me FP as agreed, much less a playable disc.  I have to decide by Tuesday, whether to leave negative or in my case there is the option to not  - keep the guitar and eat the non working (badly scratched as well, like yrs)  disc (or play frisbee with it, you know whatev)

The problem with this option is I would have to leave a positive , and there would be the possible assumption (from the seller and some of the JA on the forums) that I was lying to begin with.  because there would be no Goozex inspection.  On the positive side, I could relax and play GH Aerosmith and get some of the others game only in the near future, including the Legends of rock I was promised.  and maybe it's resurfaceable, i don't know, it would basically cost me the same to buy a resurfacer, as to get another Legends of Rock. no guarantee it would work, one at least is a very deep scratch.

So I would definitely recommend keeping Goozex in the loop in your case, only rarely do they screw over an honest user, by mistake. from what I've read.  you will most likely be much better off, safety wise.
