I had a seller claim he sent a game and never provided me with delivery confirmation.  I've had over 50 trades without leaving or receiving a negative yet, and I've even gone as far as to leave many tips for other sellers and have received a tip before too.  Well I contacted the seller and of course he has no proof he sent it except that he has some receipt but no delivery confirmation number.  

I opened a dispute with goozex and gave a negative because I did not receive the game.  They closed the dispute and issued him a positive feedback even though I NEVER RECEIVED THE GAME!!  So they took the side of some user that has less than 4 trades and no proof, over a user that has been here for years and has flawless feedback.  This is insane and fraudulent to boot.  

I ordered other games after I ordered this game from this guy and those games all made it here in a matter of days.  I still after two weeks have not received the game.  So this scumbag gets to keep my points, and I get no game.  

I don't think goozex gets that credits are considered virtual money, and they are in essence aiding someone in fraudulent activity. 

What ever happened to honesty and integrity?!

It does sound like another G-Team Customer Service snafu. I'd send an e-mail to Goozex. feedback@goozex.com

 

explain that they are wrong. Unless the guy provided them a DC # that he didnt give you, they really just screwed you over as a buyer

Don't they also consider the receipt that the buyer gets from the post office as confirmation of shipment?

Edit: I'd still contact goozex and maybe you could try contacting your post office. Maybe it got lost in the holiday rush....But if it's neither person's fault I don't think you should be penalized by losing your points.

Yeah he did not have delivery confirmation and said so in a pm to me.  He claims he has a receipt that he sent it out at the post office but not delivery confirmation.  All I know is a standard receipt does NOT show the address and doesn't provide any other information.  This guy could have been sending a family member a christmas card or gift for all I know to relatives in Florida and is using that as proof he sent something.  Maybe he did send something, but it sure as hell wasn't to me nor was it to my address!

It's things like this that make me SO happy I'm pursuing a law degree.  They are ticking off the wrong person.  I'm going for a corporate law degree to fight corrupt corporations.  Amusingly its situations like this that i'm specializing in.  

Tisk....tisk....goozex.  Defrauding buyers is not legal no matter what your terms and conditions say.  Many terms and conditions are inadmissible in court because they violate laws and the rights of consumers.  This would be one of those situations.  If a buyer has provided consideration (something of value) for an item, the buyer is supposed to provide a service or product in exchange for that consideration.  Being that Goozex receives a trade credit, they in turn are responsible to ensure the buyer is provided with the item they paid for.  By them giving him his points without him providing me with any form of compensation, they are indeed involving themselves in fraudulent activity.  

I'd be surprised if my posts stay up long because they will probably be deleted.  

I also would like to add I find it amusing that people think or label you as a trouble maker if you refer to your legal rights.  It's as if you don't have the right to mention that you have rights!  What is with that whole ideal that is getting adopted into society.  Has it come to the point where people are so brainwashed and subservient that they no longer feel that people have the right to stand up for themselves, defend themselves, and protect themselves from corporations or individuals with ill intent?!

The standard receipt from the post office shows the weight, the date, and the zip code. You don't need a law degree to figure out that the probability is pretty low of him having a buddy in your zipcode that he just happened to need to send something to that was the weight of a game in a bubble mailer during the same week that he was supposed to be trading with you.

Did you ever consider that it may be your mail carrier (or any of the people along the route the game traveled)? My gamefly games used to get snagged out of the mail ALL the time, and I remember hearing about one post office guy who worked as a sorter at a central hub who had stolen something like $10,000 worth of merchandise.

Finally, I am not really sure how this is that big of an impact to you. I was always under the assumption that Goozex returned your points if the item didn't show up. I don't know what else you are expecting from them? Am I wrong?

You are correct about the recepit it shows all that info. And i to was under the assumption that you got your points back if it got lost in the mail,but i may be wrong.

Do this, but don't tell them that the other guy has nothing to stand on. As proven, the receipt has enough info to prove he did send it. but they should still give you your points and token. Just send them a polite message, not a threatening one in the same vein as you have posted on this thread, telling them that even though it isn't the seller's fault since he did send the item out and should rightfully receive his points, it also doesn't mean your points and token should be taken because of it. Tell them that the item still hasn't arrived for you, and that you would like to be refunded your points and token since you currently don't have anything in hand. I'm sure they'll likely issue the refund since you are an outstanding trader.

Yes, there's a shortage of lawsuits in this country.   Is this the sort of thing they teach you in law school?   Big Smile

That's the second thing you learn... the first is that vague threats of a lawsuit with absolutely no legal grounds are a surefire way to get customer service disputes resolved in your favor.

Proof of shipping is not proof of delivery. Goozex should never penalize a buyer for that.

While I support the buyer based on the facts presented, I can't condone the seemingly self-righteous attitude - especially when presented with helpful (and valid) advice from peers.

OP, I can understand why you would be upset and hopefully this is looked into.  At the same time...dude, really?  Hmm

Maybe he is being penalized for all of his trolling posts?Wink If something is lost in the mail, usually both sides "win" so to speak. Perhaps you need to wait the 24-72 hours for Goozex's decision to become final?

I'm with the other posters, the screaming attitude won't get you anywhere. Anytime I've had a problem with goozex's service, I send a polite, detailed e-mail through the proper channels. They have ALWAYS handled my problems albeit not in the most timely matter, but it DOES get handled.

Screaming and yelling at customer service will ONLY put you on the back burner. Goozex customer support can take time, and pissing off them will not help your cause.

Proclaiming that you are pursuing your law degree and making vague threats of lawsuits is childish at best and not very becoming of a lawyer either IMHO.
