A while back I posted about a gamer with a disability who was banned from PSN for his improper conduct and subsequently sued Sony for pain and mental anguish.
Well...he didn't stop there:

Erik Estavillo, the Resistance: Fall of Man gamer who sued Sony Computer Entertainment America (SCEA) over being banned from the PlayStation Network has targeted the remaining two major console makers in a new lawsuit.Microsoft Corporation and Nintendo of America are defendants in a federal complaint, which was filed November 18 in the U.S. District Court, Northern District of California.Microsoft is being sued for a “red ring of death” affecting the plaintiff’s Xbox 360 console. Estavillo notes that as he is disabled, he cannot afford to pay the “well over $100” fee to fix the console, nor can he afford to purchase a new one. He feels “that Microsoft should have to bear the burden that is now put on the shoulders of this disabled plaintiff.” Estavillo is seeking $75,000 from Microsoft, due to the “undue stress” he has undergone since the 360 broke and the “sadness he will have in the mean time of finding one he can afford.”The same complaint targets Nintendo over a Wii system update. Estavillo claims that update 4.3 disabled his Homebrew Channel, which he used to unlock characters in Mario Kart Wii. Plaintiff states that the only way to unlock characters in Mario Kart Wii is to purchase Super Mario Galaxy, which will unlock a single character in the former title. “In essence, Nintendo is forcing customers to buy another game to unlock one character in a different game.”Damages to the tune of $5,000 are sought from Nintendo, for interfering in plaintiff’s “pursuit of happiness.” An injunction is also being sought to prohibit Nintendo from “deleting, blocking or prohibiting the Homebrew Channel and Ocarina applications.”Estavillo says he suffers from depression, obsessive-compulsive disorder, panic disorder, agoraphobia and Crohn’s disease, all of which lead to his leaning on videogames “heavily” for happiness.Estavillo plans to file a lawsuit in state court as well, which he wrote will “pretty much” be identical to the federal suit.
I'm all for accommodating those with disabilities. However, this may be taking things a little far.
What's everyone's take on the matter? Does this gentleman have a proper legal case or is he simply pushing the matter too far?

100% idiot so far.
There was also recent suit by a blind person against Sony charging that they weren't making games accesible enough to the disabled. Here's a link to the article and also another feature on blind gamers on Gamespot.
I can empathize but also to be fair, "video games" have the word "VIDEO" right in there. Optic input is kind of a given. It's kind of like attacking radio stations for not being more deaf-friendly.

DISC & CASE FTW!
If you bricked your Wii because you were running Homebrew software and then you sued about it, then you don't have a leg to stand on, especially considering Nintendo warns you when you are about to update that if you are doing so, you might end up with a bricked system.
The guy is obviously a moron.
Now, this "disk + case" business on the other hand...
Idiot. No question.
I didn't vote because "****wad" wasn't on the list.
No offense to anyone in the thread who may have tourettes.

This. And back to that Ocean City conversation I was having with crimenole and devyanks......
I played your little game, but only to see if anyone voted Crusader :)
The guy who votes that should be banned, or we'll be the next target for a lawsuit!
Oh yeah, DisK + case!

How long did it take you to wash off the sludge? I could've sworn the smell was still on you from the meet you attended last year.
Alright, let me start by saying I do feel bad for the guy that he has disabilities...
With that being said, what an asshat. This guy is just trying to get all this money out of sympathy for the fact that he is disabled. I get it, it sucks, but 75,000 dollars for anguish over your 360 not working...come on dude...I wish we had Randal in Clerks II to tell this guy what he needs to hear.

If you are talking about wildwood, or North Jersey beaches I'll agree. On the other hand, Ocean City, LBI, and a few others in South Jersey really aren't bad...it's North Jersey that is dirty, not south

Just because you and your midget (IWX) repeatedly say its the north and not south doesn't make it truth. Jersey people may have fooled yourselves, but you're not fooling anyone outside of jersey.
