here is what would happen

someone gets a good condition game and messes it up then blames it on the guy before them when they were the ones who actually did it. That would probably happen too much

Proper communication between buyer and seller prior to carrying out trades would alleviate a lot of the headache, IMO.

For example, consider the following; I received Blue Dragon a few months back-- game discs were flawless, while the case and booklet were pretty torn up.  When I was matched to trade out, I sent the prospective buyer a PM regarding the condition of the item BEFORE accepting the trade.  This allowed the buyer the opportunity to make the decision regarding what condition they were willing to receive, rather than having the seller make that decision for them.  

If he didnt respond in the 26 hour accept window, would you let it timeout or just assume his silence indicates his approval?  And also if he didnt want it, I assume you'd let it time out, but would you do so if Goozex made policy changes that came down harsher on users who let offers timeout?

I have never let a trade timeout.  If a buyer were to indicate that the condition I was offering was not what they were interested in, I would Reject the trade.  If the buyer chooses not to respond (regardless of whether they read my PM or not), I view it as their loss at the chance to nitpick about condition, and I'll send it out.
