I personally would leave negative feedback.  You will get your points back and spot back in line after the dispute is over (if he even disputes it).  If he does you will have to send the disc to goozex but you are protected and will get everything back.

I received a broken disk. The seller claims everything was in good condition when he mailed it out but there are no tears or rips in the packaging to make me believe that it occurred during shipping.

Giving the benefit of the doubt to the seller,  if i ask him to cancel the trade will i get my points back and be put back in the front of the line to get matched up with the next user?

Or should i initiate the cancellation? Whats the difference?

if he initiates the cancellation, yes you get your points back and are back in line at the position you matched for the game at

yea i did leave the negative feedback and it says dispute is open for x amount of days i was just wondering what to do first time sending or receiving negative feedback.  He PMed me saying he was sorry and asked if he could do anything to fix it

in this case it would look at the user's feedback history before making my decision; discs can get damaged in the mail, it happens
