I don't like No Doubt either. They can't expect anyone to take them seriously when they're appearing in a video game in the first place. A polygonal representation singing someone else's songs isn't going to harm their 'artistic credibility' any further. Maybe there was some misconduct on Activision's behalf, maybe this whole lawsuit is frivolous. Nobody can tell without reading the contracts.

Here are some more bands we can't take seriously. ANd lets not forget that Tom Morello guy from Guitar Hero III. He and Rage Against the Machine are just metal-rap junk.

Are you being sarcastic? See this is the internet and I can't always tell. If you're trying to make the point "Look at these once talented musicians who have long since become commercialized and irrelevant" then point taken.

Well, it does bring up a point that hasn't come up... those GH: Band games all feature the main act playing other people's songs without complaint, and yet somehow this is an issue now.

History does not merit make. That's my entire point. If the case was No Doubt vs. say Take Two or Sony  or Atlus with the same facts and accusations, you would appraise the situation in an entirely different light and you have admitted that in so many words.

Of course it would be appraised differently Atlus doesnt publish Guitar Hero.   I'm talking about the specific history of Activision's business.

What other context could this lawsuit be in ? I'm not sure what you are trying to imply other than "hexpane is da bAIS!"?  Just for the record, I HATE NO DOUBT, their music makes my physically ill and I find Gavin Bush Rosedale to be one of the biggest poseurs and rip off artists in the history of "fake grunge".

I also despise Courtney Love and her handling of the Nirvana estate... So it's not like I'm some fanboy rooting for 'my side"

We now have 2 independent artists, both who signed contracts w/ Activivision both claiming the same thing.

I find it very interesting that 2 artists would be making these claims, and go back to my "good faith" argument.  If Activision really did negotiate in good faith, why would the artists be surprised at the result?

I'm sure it's buried in the contract somewhere, but in good faith negotiations, you don't bury critical components in endless volumes of legal docs.

Since when?  I didn't see that in any of my copies of those games....

I don't know why bands agree to sign contracts on the game in the first place, a simple "NO" and none of this would be happening

Their third wave ska, which makes them at least kind of punk, and they had some songs that were NOT ska. Like Hella Good and Hey Baby.

Well as GW Bush once said to "Put food on your family" ... they need to sell music to survive.

Wasn't Hendrix locked to only Hendix songs in one of the guitar heroes?  I think that's what bands were thinking.  Not as extreme as BEatles RB only allowing beatles music and no beatles music in other RB, but Hendrix only playing Hendrix makes sense.

Magically the Kurt Cobain getting "raped" youtube video was taken down by activision once this whole thing blew up.  Yet other GH videos are not taken down... gee I wonder why.

And I am talking about the situation as a general example because you are indeed coming at this from a prejudicial state of mind.

You may dislike No Doubt and Courtney Love, but you absolutely detest Activision, and talking to you about this is like discussing a dispute between two third parties where one of them was sort of mean to you in high school and the other one ran over your dog. Even though you dislike one, you despise the other.

Let me reframe this for you in another way. NIS wants to make another Disgaea game, and they secure an agreement to base a character on Bruce Willis' likeness and voice (amongst other actors and actresses), which he agrees to. Of course, knowing that series, you know that often times they also build a class around specific characters, and this time they allow players to make multiple characters based on the original Bruce Willis one they designed, and the variations use another actor's voices and animations.. He says that this makes a mockery of him, and he sues, despite the fact that earlier episodes of the game have features like this and it is a reasonable extension of the game.

Why would it be a surprise indeed considering the long history the Guitar Hero franchise of having real musicians as fully playable characters. If  Guitar Hero 5 and Band Hero were the first installments to have that feature, I could see this being an issue, but come on. You honestly expect me to believe that no one involved in all this had any idea that this is exactly how this franchise worked? That somehow the fact that many A-list performers have appeared as fully playable characters in the series. You mention Jimi Hendrix in another post. He was perhaps the only exception to that status quo out of 20 before Band Hero.

It is like a boxer agreeing to appear in Fight Night game and then objecting that their character being able to fight boxers from other eras and weightclasses when that is the bread and butter of the series.

Let's see.  I'm not too fond of the business practices of Activision.  On the other hand, I don't care for No Doubt in the least, either.

Verdict?  Couldn't care less.

I just think it is funny that my posting this and noting that I thought it was a stupid lawsuit based on the actual "injury" ended up turning into a huge anti-Activision free for all.

The internet... where anything is three comments away from a flame war.
