Do i just leave negative feedback? Do i give the person a chance to resolve it (not sure how they can really)... The disc is scratched to heck(after the case was crushed, it slid around and had the little green pieces in there), but it APPEARS to play, at least the begining, but what if it craps out later 10 missions in, then, what can i do?

you must test the game thoroughly, scratches or not; if you leave negative and they claim playable, you will have to send the game into goozex for inspection
Also, don't throw that mailer away. If required to ship to Goozex for testing, send the bubble mailer with it to prove the seller didn't take proper precautions with the mailing material.
You mention the green pieces of the box, so is it an Xbox 360 game? If it is, try installing it to the system's hard drive (if it has one). If the game installs, then it works.

sounds like a +5 to me then; some could argue that its a neutral though because the case is obliterated and he didn't take proper measures to protect

This sounds like they knew they where doing wrong. But i guess its a plus 5 feedback. Take a look at there trading history and see if this happens a lot. If his trading history looks like it does send a message to the Gteam not sure if they will do anything about it but it wont hurt.
