I just got a package in the mail, it is from a new seller. The game was supposed to be Marvel Ultimate Alliance 2, Instead I got a package with a note from the seller. The game was missing.
It looks like something happened in the post office. Package looked open from the side and resealed with some kind of glue. I believe the seller sent the game in good faith, he used DC and even left me a nice note. However with the game being missing, what should I do. I don't want to leave negative feedback but I also don't want to lose my points.
I would start by contacting your local post office. Tell them the package looked opened and hastily resealed and that it was empty inside. It seems illogical that someone would spend money to send you an empty box.

Email feedback@goozex.com and explain your situation. It may take a day or two for them to respond. I'd also contact the seller and let them know what happened.
Check the seller's feedback for negatives or changed feed backs and decide from there.
If someone left him a negative for game not received, but goozex reversed it because of him having DC, their comment about not receiving it will still be there.
If you see that other people were complaining about not getting their games, then you should leave negative and point it out to Goozex.
Otherwise, if he's a good seller, only thing you can do is complain to the Post Office, but it's unlikely they'll be able to do anything. Who knows, though!

Will the seller get his points back? I have a somewhat similar situation where DC shows a game coming to me delivered to the wrong ZIP code. obviously I want the seller to get his points back too

Well I've e-mailed goozex and still no response to my situation. Should I go ahead with the negative or just wait it out.
go ahead with the negative and start a dispute process. This may be an easier way to get Goozex to look into it.
Okay, still no response from goozex, is it just me or has there customer service suffered as of late. I am to the point where I am just going to leave negative feedback but the seller is such a nice guy.
How long should I wait before I take this action.

Waiting for too long will make this harder for everyone. Doing these actions might cause some stress... but will also get things rolling to (hopefully) be fixed.
