Well here is my take on the situation.  As a buyer I dont usually open sealed games up before leaving feedback.  I should make sure to open them up but I always forget.  Also I have been here for long enough to have seen another situation almost exactly like this posted on the forums.  A user got a game from someone who had purchased it sealed from Target.  When they opened it up it contained a crappy pirated game on it.  The reason it didnt contain the right game is because someone bought the game took it out, put a different one in, resealed it and took it back.

Anyways this would not be the first time this has happened so I dont consider the buyer overly suspicious.

i'd side with the seller, buyer has already left positive feedback with a tip to boot, end of story.

Good luck on getting a store to take back a game like that.  Most places won't even give you a refund if you had the original game in the box, let alone tell them you bought a game and somehow a pirated burnt disc got in there.

Ya i just want my game as i said i don't think he did this i think he got a bad game i just want to race i will send what ever the hell this disc is if we can work something out. I mean with 50 games i have trade with on goozex this has never happend so i don't know what to do i tip the man for a brand new game with fast shipping but did not open that day as i was busy packing stuff up to move.

That is exactly right.There were some scammers in a walmart who bought a lot of games,took the discs out,sealed them,and brought them back.I will get the youtube video.

This is the first thing i when to i mean i got a new game a long time ago at gamestop and when i got home the botten was cut open and the pulled the disc out and took the case back to the store, I just want this fixed i don't care if i get the points back or he sends me a copy or something but this is not what i payed for and this was a big let down on me and for goozex now my firend will not sign up in fear of something like this even after i told him i has got a crap load of games and this is the first time this has come up.

I don't think it's unreasonable to believe that both traders here are victims of a third-party scammer. Hopefully the Goozex guarantee goes into effect on this one and the seller keeps his points and the buyer gets his points/token/original place in line back.

Yes, this seems like one of those trades where Goozex is going to take the hit instead of either user.

Any thing would work i mean i don't want to put the disc i got in my laptop in fear of what could be on it,i may be a dream cast game but i don't have one so i can't check but it is not a ps3 game that i know but thanks IWX  makes me want to play it more i loved the first, I don't want goozex to take a hit on this i love goozex i have got some of my fav games back and i have had a ps3 for 3 months now and got a little over 50 games for it i could have not had that happen with out goozex.

About half the games I sent out on Goozex were sealed games from Target or Amazon. I have yet to have a single person complain about what you're saying. I seriously feel like you're trying to scam me out of some points for god knows why. Yeah, I may be a new user, but I don't understand why it would make sense for someone with a pretty good track record sitting on 3000+ points to risk sending you a fake game. I've done about 12 other trades since the beginning of August without a middle man and they've all gone through fine.. I have a feelign you're probably btoh innocent.   The sender doesn't seem to have any bad history as a sender and the receievr doesnt have any bad history for scamming to suggest he would start now.  My guess is probably that the sender bought the game new to flip on Goozex and before he even bought it, it was already jacked.  Maybe it was packaged wrong or returned and reshrunk wrap by some previous user and the sender had the misfortune of buying it after it was reshelved I dunno. 

But both sides seem reputable in this case.  The sender doesnt have a reason to send somethign like that on purpose. The receiver has no real need to pull somethign liek this after a particularly long and good Goozex track record.It doesn't make a whole lot of sense why he would intiially leave positive feedback if he was plannign to scam.

My suspicion is that probably Goozex will side with both of you. and restore the receivers points/token, but the sender will still get his points and positive feedback.   I don't know, just a guess, considering btoh of your track records are pretty clean. I'm curious to see what happens.

EDIT: whoops,looks like this was alreayd said.  I thought I was reading the second page of the thread, btu I guess it was still the first.  Stupid forum glitch that doesnt let you navigate through the pages of question topics.

Well thanks i don't want the other guy to get hit with a big -250 on his feedback thay could hurt his goozex account and make it hard to get back up to having good feed back i just don't know what do to do he looks like he did not do this and we both just want to be happy and have it work out.

So what do you do if you were to buy a new game at walmart / target and it was one of these blank cd thingees?  Because they don't let you return games that are opened and I imagine the customer service returns desk would have a hard time believing you that you opened up the game and it had a CD that said "Memorex" on it unless they were made aware of the scamming story above.

I understand they are both upset, as you both should be, and I think they are both telling the truth, however accusing PVT of being "shady" and then saying "I'm really sorry if you just got really unlucky" and "I'm not trying to call you a complete liar because something real could have happened" is not cool. Taking opposing stances on a dispute severely diminishes your credibility.

I am inclined to suggest that a shady person bought the game from target (not misoleet, for the record), put the other disc in, rewrapped it (easily done if you know someone who works for disc resellers), and returned it. Target being none the wiser. They can resell the game as new with the wrapping, then misoleet unknowingly purchased the fraudulent item, and you know the rest.

"I do not have a problem with the copy I kept and the other guy from CAG has not mentioned anything either." and "I've purchased a butt load of games from Target and I've never had a problem with them at all" are EXTREMELY irrelevant. C'mon...these things can happen, and when they do it is typically not on a mass scale.

Someone's gotta lose on this one, goozex will have to decide which one. What we should all take from this is DO NOT SEND prewrapped games. The chances of this happening are so miniscule that it doesn't even come to mind. Is it really worth the headache?
