yes leave negative feedback....and your not actually stuck with the game you could take it to a repair shop it costs like 2 bucks...but if u dont do it and u do trade it to someone else then you'll get negative feedback..so thats really your only option

Not necessarily. Before you ship it out, just PM whoever you are matched with and inform them that it has two bad scratches but that it is playable (as long as you test it out by installing to the hard drive to ensure that it is, in fact, playable). Some may cancel the trade, but if the game works I bet you'll find that a lot of people couldn't care less.

That's what I do, and for the most part, people really don't care. (Of course, most of the scratched up games I have are thanks to Gamestop )
I would personally recommend to delete some more of your DLC (you CAN always redownload it, dont' forget) and try installing it on your 360. You CAN check it on your PC, but don't forget that the laser in your DVD drive on your computer is NOT the laser in your 360 and what your PC can read your 360 might not.
Also, if the game DOES fully install with no issues, check Skippy Disc to get the disc resurfaced. If the scratch is too deep, it won't come out all the way but it'll look loads better.
Again, I highly suggest deleting some more files on your 360 and doing an install. It'll be a pain in the ass redownloading everything you had to delete, but it'd be the best method to make sure the disc works.

Is there a ceartin number of times you can download a game to a hard drive? Other than hard drive memory, what's to stop people from getting a game, downloading it to their hardware and then returning or shipping it back?

You cannot play a downloaded game that is not an Xbox Live Arcade game off of your hard drive without booting it with the original game disc.
If it is an Xbox Live game it can only be played on the console it was purchased on OR you must be logged in to Live with the gamertag that purchased it.
EDIT: (Technically with this method I could take MY gamertag, log in to YOUR console and buy a Live game, then log out. You will be able to play it because it was purchased on YOUR console. Then I could go home download the game to MY console, login to Live and play the game too. If I ever can't connect to Live I can not play the full version of the game though.)
If it is a physical game disc that was copied to the HDD, then the disc MUST be in for the game to start. Then it will load off the HDD.

As I said, you still need the disc to boot it up, but after that it plays off of your HDD.
No you can not play it. The retail game disc MUST be in the system to play a game off of the hard drive.
You can back up as many games as you like, but the system still checks to make sure the disc is in before it will boot up. If the game is ripped to the hard drive, once you load up the game, it reads it off of the hard drive instead of the disc. If the disc isnt' in the system, then it's just data sitting on your hard drive. You MUST have the disc to access any game you rip from the disc to your hard drive.

That, in case you accidentally bump into it while it's vertical and it gets horribly scratched, or so it doesn't sound like a jet engine revving up.

It is also marginally faster from the HDD also.
Depending on the game, it can be a HELL of a lot faster. Not to mention the lack of wear and tear on the disc drive...If i'm playing a game for more than a day, I'll spend the 10 minutes to install it.The only major game (so far that I know of) that doesnt' benefit from loading to the hard drive is Halo 3 because it's already designed to copy data to the hard drive as it's needed.
